I must say I feel comforted by the fact that Judges realise that we are operating in an ‘atmosphere of uncertainty’ when it comes to costs management.
It is very difficult to accurately predict what might happen in a case and to be tightly bound by that prediction would be an injustice to all the hard work that goes in to a case by costs draftsmen, solicitors, barristers and judges alike. Lest we not forget that costs also carry enormous consequences for paying parties and for client’s funding cases in the first instance.
Lets hope that we do receive some authoritative guidance in the near future so that we can all out our energies into doing the best job possible, knowing that common sense will ultimately prevail.
Well, we can live in hope!!
